Definitions
The capitalized words in this document have the meanings specified in this section.
Customer: Refers to the Consumer/Professional who intends to purchase Products through the Site.
Consumer Code: Refers to Legislative Decree No. 206/2005 and subsequent amendments.
Consumer: Refers to an individual who purchases Products for non-commercial or non-professional purposes, as provided for by the Consumer Code.
Intellectual Property Rights: Refers to all intellectual and industrial property rights, copyrights of any kind, registered or unregistered, in any jurisdiction worldwide, including rights to industrial designs, patents, the Site, Products, utility models, copyrights, trade secrets, know-how, trademarks, and distinctive signs in general, inventions (patentable or not), processes, methods, technical information, designs, or any registration request or registration rights related to the Seller concerning the Site, Products, and Platform.
Purchase Order or Order: Refers to the formal expression of the Customer's intention to purchase certain Products, through the Site, including the Customer's identifying information, the Product(s) to be purchased, and the exact delivery location.
Professional: Refers to a legal or natural person who purchases Products for their commercial or professional activities.
Product(s): Refers to the products offered for sale through the Site, as described in the respective technical information sheets or communications sent by the Seller and offered for sale on the Site at the time of submitting the Purchase Order.
Seller: Refers to Caminus Capodimonte S.r.l., with its registered office at Cassino FR - Via Ausonia Km 1500 CAP 03043 (hereinafter "Seller"), email info@agathoparfum.com.
General Information
The Seller offers the Products listed on the Site for sale through the Site and its related e-commerce platform.
By using the Site, the Customer agrees to these terms and conditions.
Purchase of Products
To purchase Products through the Platform, the Customer must:
- Access the Site.
- Select the Product they wish to purchase.
- Follow the ordering procedure on the Platform, accepting the terms and conditions in this document, checking the privacy information and confirming that they have read it, and checking the section related to marketing activities only if the User wishes to provide their express, specific, and separate consent for this purpose. Then, submit the Purchase Order. Before confirming the Order, the Platform allows the User to modify the entered data.
- Enter their contact information for delivery (i.e., name, surname, delivery address), a phone number (mandatory) to contact the Customer during the product delivery phase, and an email address to receive the confirmation and summary of the Product Purchase Order.
- Make the payment for the purchased Products, as indicated at the end of the purchase procedure.
- Wait for a message from the Seller to confirm the Purchase Order, which will be viewable on the user's account and can be sent upon request and independently archived.
This message will also include:
- Customer's summary information
- Specific indication of the purchased Product
- Date of the Product purchase
- Order number
- Total price paid by the Customer
- Shipping costs and related taxes/duties
- Shipping address of the purchased Product
- Payment method
Receive an email with the package's tracking number.
From the moment the Seller effectively collects the price indicated in the Order, the phases related to the shipment of the purchased Products will be initiated.
Once the sales contract is concluded, the Customer will receive an order confirmation via email, and for sales made outside the European Union, a paper invoice will also be sent, as it is necessary for the completion of all customs procedures.
The Purchase Order submitted by the Customer constitutes a contractual purchase proposal subject to confirmation by the Seller, as described below.
Shipping and Delivery Times and Methods
The delivery of Products can be made within Italy, countries that are part of the European Union, and non-European countries where the shipment of Dangerous Goods is allowed by Italy. The complete list of countries where orders can be placed can be found on the Country Delivery page. In any case, the total amount of shipping costs, if not included in the overall price, will be indicated in the order summary before the Customer confirms and submits the Purchase Order for the Product.
Products are shipped once the price of the Products is collected, using couriers affiliated with the Seller and delivered to the address provided by the Customer at the time of submitting the Order.
The expected delivery times will be indicated on the Country Delivery page and will commence from the date of successful payment for the purchased Products.
At the time of delivery of the Products by the courier to the address provided by the Customer, the Customer is responsible for verifying the integrity of the package and the correspondence of the number of pieces with what is indicated on the transport document.
The Customer is aware that if the package containing the purchased Product appears to be tampered with, they should refuse the delivery with the express indication of "Tampered Package."
Delivery is carried out by couriers selected by Caminus Capodimonte S.r.l., and the service conditions of these couriers apply, to which reference is made.
The delivery of the Products is considered validly completed at the recipient's civic number or at the location expressly indicated by the recipient during the order phase in the Shipping Address section.
The Seller is not responsible for any delivery delays and/or additional charges incurred by the Customer in case of an incomplete or incorrect address.
In the event of the Customer's absence on two consecutive occasions at the place and time of Product delivery, the Seller reserves the right to request reimbursement for the expenses incurred for resending the package containing the Products.
The Seller reserves up to 72 working hours, unless unforeseen circumstances occur, for the preparation of packages and courier delivery.
Product Prices and Invoicing
The prices of the Products listed on the Platform include VAT and any other taxes for all sales made in the European Union, while they are exempt from taxes and duties for all sales made outside it. Before submitting the Order, the Customer is informed of the delivery costs for the specified destination.
The Customer commits to paying the price indicated in the Purchase Order and any additional costs as specified, if applicable.
The Seller is not responsible for any customs duties and taxes required from the customer during the product customs clearance process. Any additional duty or tax will be the responsibility of the customer, who is free to accept or refuse to pay, but aware that they cannot request a refund from the Seller.
Seller's Liability
The Seller assumes no responsibility for service disruptions due to force majeure. Examples of force majeure include, but are not limited to, actions by Public Authorities, strikes by the Seller's employees or the carriers used by the Seller, as well as any other circumstance that is beyond the control or will of the Seller.
Customer's Obligations
The Customer is obliged to review and accept the information contained in the General Conditions, which must be reviewed before submitting the Purchase Order.
Acceptance is done by flagging or marking the appropriate section on the Platform, and in its absence, the Order cannot be executed.
Right of Withdrawal for Consumer Customers (Non-Professionals)
Only the Consumer Customer, for any reason, has the right to withdraw from the contract entered into and return the delivered Products, without any penalty and without specifying the reason, provided that they exercise this right within fourteen days from the date they physically take possession of the Products.
The aforementioned right can be exercised against Caminus Capodimonte S.r.l. by the Consumer Customer through any explicit declaration of their decision to withdraw from the contract, to be sent to Caminus Capodimonte - within fourteen days following the date of receiving the Products - at the following alternative addresses:

Please note that the costs for returning the Products under this article (right of withdrawal) are at the expense of the Customer.
After communicating the desire to return the Products, the Consumer will have fourteen days to return them, without delay, using the courier trusted by the Seller. If the return is made by the Consumer using different methods, all additional shipping and delivery costs will be at the Consumer's expense.
The Consumer will receive a full refund of the amount paid, within fourteen days from the date the Seller has received the Products and verified their integrity in all parts.
The returned products must be intact, unopened, and in the same packaging in which they were shipped. If they are found to be used, they cannot be refunded.
Please note that customized products are not subject to the right of withdrawal as outlined in this article.
The right of withdrawal cannot be exercised for Products purchased by Professionals or, in any case, by individuals other than individual Consumers.
For purchases made by private customers or businesses or freelance professionals outside the European Union, it will not be possible to return the products purchased to Caminus Capodimonte S.r.l. because couriers do not allow private individuals to ship Dangerous Goods to Italian companies.
Payment Methods
The Customer can pay for the ordered Products through:
- PayPal
- Credit card.
- other payment methods made available by the seller
Please note that payment details will be transferred directly to the payment service providers, whose general terms of service and privacy information will apply and to which reference is made. These documents will be made available to the Customer at the time of payment.
Legal Warranty
Consumer Customers are offered the so-called legal warranty on the purchased Products, also known as "conformity guarantee," which protects them in case the purchased Products have defects in conformity with the sales contract, covering defects in conformity that occur within 24 months from the delivery date of the purchased Product.
The Seller guarantees that the delivered Products are in conformity with those presented on the Platform and indicated in the Purchase Order.
The Customer may report the defect by writing to the Seller at the addresses indicated in article 1 or by filling out a specific form that accurately describes the defects of the Product.
The costs for returning, replacing, and/or repairing the Product in this case are at the expense of the Seller.
In case of a conformity defect in the product, the Consumer has the right to:
- Restoration of conformity,
- Reduction in price through a voucher or partial refund,
- Resolution of the contract.
For the purpose of restoring conformity to the product, the Consumer can choose between repair and replacement, provided that the chosen remedy is not impossible or excessively burdensome for the Seller, taking into account:
the value of the product in the absence of the defect,
the extent of the defect,
the possibility of applying the alternative remedy without inconvenience to the Consumer.
Repair or replacement takes place:
- at no cost,
- within a reasonable period of time,
- without significant inconvenience to the Consumer.
The Consumer has the right to a proportional reduction in the price or contract resolution:
- if the Seller has not carried out the repair or replacement of the product,
- if a conformity defect still exists despite an attempt to restore the product,
- if the conformity defect is so serious that it justifies a price reduction or resolution,
- if the Seller has declared or circumstances show that they will not restore conformity within a reasonable period.
In any case, the Consumer has the right to a price reduction proportional to the decrease in the value of the product.
The consumer does not have the right to terminate the contract if the non-conformity defect is minor, and it is the responsibility of the Seller to prove it. Furthermore, the Consumer may refuse to make the payment for any part of the price until the Seller has fulfilled the obligations provided in this section on the conformity guarantee.
If the non-conformity defect only concerns some of the goods delivered, the contract can be terminated only with respect to those goods.
In the case of termination, the Consumer:
- must return the goods to the Seller at the Seller's expense,
- the Seller will refund the Consumer the price paid for the goods upon receipt of the goods or upon receipt of evidence provided by the Consumer concerning the return or dispatch of the goods.
These rights can be exercised through a request to be sent to Caminus Capodimonte at the following alternative addresses:

Please note that the Legal Warranty is granted only to the Consumer, i.e., those who purchase products for non-professional purposes and not to Professionals.
It is also clarified that certain characteristics of the Products may appear as defects (e.g., not entirely uniform leather coloration or irregular stitching) but are actually an expression of the manufacturing and craftsmanship of the Products themselves and, therefore, cannot be qualified as defects.
The right of withdrawal as specified in article 9 of this document remains in effect.
Intellectual Property
It is emphasized that all Intellectual Property rights related to the Site and its contents are owned by Caminus Capodimonte.
Consequently, any use of the same by any user of the Site for purposes other than mere consultation and/or for requesting the services of the Site itself and, consequently, for the purchase of the Products, is prohibited.
Use of the Platform
Any use of the Site, the Platform, and their contents that deviates from what is stipulated in this document is expressly prohibited, and the Seller reserves the right to take any action to protect its rights.
Applicable Law, ADR/ODR, and Jurisdiction
Contracts entered into online through the Platform are governed by Italian law.
For anything not expressly provided here, the applicable legal provisions apply to the relationships and cases specified in the contract concluded online by the Consumer and/or Professional with the Seller.
The customer can file a complaint with Caminus Capodimonte by sending a communication to resolve any issues they may encounter, to the following alternative addresses:

If the customer is not satisfied with the handling of the complaint as described above, they may file a complaint through the European Union's ODR platform, accessible at the following link: http://ec.europa.eu/consumers/odr/, which serves as an access point for users who wish to resolve disputes arising from online sales or service contracts outside of court.
For any dispute between the Consumer Customer and the Seller regarding the provisions of this document, the jurisdiction of the court in the place of residence or domicile of the Consumer, if located in Italian territory, is competent.
Any dispute regarding the application, execution, interpretation, and violation of the contract concluded online by the Professional with the Seller is subject to Italian jurisdiction, and the court of Rome is competent.
The general legislation on the sale of goods in the civil code applies to Professional Customers, other than individual Consumers.
